GrowthHub Studio is an AI-powered content creation and publishing platform that helps users generate scripts, voiceovers, videos, captions, thumbnails, and SEO metadata, and manage publishing workflows for supported social media platforms. Our tools are designed to improve productivity while complying with the policies of third-party platforms.

These Terms form a binding agreement between you and GrowthHub Studio. If you do not agree to these Terms, you must not access or use the Service.

• "Service" means the GrowthHub Studio website, applications, APIs, and related services.
• "User", "you" means any individual or entity that accesses or uses the Service.
• "Content" means any text, script, image, audio, video, metadata, or other material generated, uploaded, or published through the Service.
• "Connected Account" means a third-party social media account you authorize GrowthHub Studio to access through official OAuth authentication.
• "Third-Party Platform" means any external service that GrowthHub Studio integrates with, including but not limited to YouTube, TikTok, Meta/Facebook, and payment or AI providers.

By creating an account, connecting a social media profile, subscribing to a paid plan, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, or have verifiable permission from a parent or legal guardian, to use the Service. You are responsible for ensuring that your use of GrowthHub Studio complies with all applicable laws and the policies of any third-party platforms you connect.

To use the Service you must create an account. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security and confidentiality of your credentials.
• Promptly notify us of any unauthorized access to your account.
• Accept responsibility for all activities that occur under your account.

We may refuse registration, or suspend or terminate accounts, that we reasonably believe violate these Terms or applicable law.

Certain features of the Service require a paid subscription. By subscribing you authorize us, and our payment processors, to charge the payment method on file for the applicable fees, taxes, and renewals.

• Subscriptions renew automatically for successive billing periods unless cancelled before the renewal date.
• Prices, features, and usage limits may change; we will provide reasonable notice of material changes.
• Failure to pay subscription fees may result in downgrade, suspension, or termination of premium features.
• All fees are exclusive of applicable taxes unless expressly stated otherwise.

The Service uses artificial intelligence to generate scripts, voiceovers, visuals, captions, and other Content. AI-generated Content may contain inaccuracies, hallucinations, or material that requires editorial review. You are solely responsible for reviewing, editing, and approving all Content before it is scheduled, published, or otherwise distributed.

GrowthHub Studio does not guarantee:

• Viral performance or specific view, follower, or subscriber counts.
• Monetization eligibility or approval on any third-party platform.
• Revenue, watch time, engagement, or search-ranking outcomes.
• The factual accuracy or non-infringement of AI-generated outputs.

GrowthHub Studio connects to supported social media platforms exclusively through each platform's official OAuth 2.0 authentication flow and official APIs. We do not collect, request, or store your social media passwords.

• By connecting an account, you authorize GrowthHub Studio to perform only the actions covered by the scopes you explicitly approve during the OAuth consent flow.
• OAuth access and refresh tokens are stored using industry-standard encryption and used solely to provide the functionality you request.
• You may revoke access at any time from within GrowthHub Studio or directly from the third-party platform's security settings.
• We honor the terms, developer policies, and rate limits of each connected platform, including YouTube, TikTok, and Meta/Facebook.

You agree to use the Service only for lawful purposes and in a manner consistent with:

• All applicable local, national, and international laws and regulations.
• The terms of service, community guidelines, and developer policies of every third-party platform you connect.
• Generally accepted standards of honest, non-deceptive online conduct.

You must not, and must not attempt to:

• Violate the terms or policies of any third-party platform.
• Upload, generate, or publish content that is illegal, defamatory, hateful, sexually exploitative, or harmful to minors.
• Infringe any copyright, trademark, publicity, or other proprietary right.
• Harass, threaten, abuse, impersonate, or defraud any person or entity.
• Distribute malware, spyware, or any malicious code.
• Attempt unauthorized access to, probe, or disrupt the Service or its infrastructure.
• Reverse engineer, decompile, scrape, or extract non-public data from the Service, except as permitted by law.

Zero-tolerance on artificial engagement. GrowthHub Studio does not provide, sell, facilitate, or support fake views, fake followers, fake subscribers, fake likes, fake comments, artificial watch time, bot traffic, engagement fraud, or any other form of artificial manipulation of social media platforms. Accounts found using the Service to attempt such activity will be terminated.

You retain ownership of the original inputs and outputs you create using GrowthHub Studio, subject to any rights of third parties whose content or trademarks are incorporated. By using the Service you grant us a limited, worldwide, royalty-free license to host, process, transmit, and display your Content solely as necessary to operate, maintain, and improve the Service.

GrowthHub Studio retains all right, title, and interest in and to:

• The Service software, source code, and infrastructure.
• The GrowthHub Studio name, logos, marks, and branding.
• The user interface, designs, and documentation.
• Proprietary models, prompts, and algorithms developed by us.

The Service integrates with third-party providers including, without limitation:

• Google and YouTube (YouTube Data API Services)
• Meta and Facebook (Graph API)
• TikTok (TikTok for Developers)
• Stripe and other payment processors
• OpenAI, ElevenLabs, and other AI or media providers

Your use of these services is also governed by their respective terms and privacy policies, including the YouTube Terms of Service and the Google Privacy Policy. GrowthHub Studio is not affiliated with, endorsed by, or sponsored by Google, YouTube, Meta, Facebook, TikTok, OpenAI, or any other third-party platform mentioned in the Service.

GrowthHub Studio interacts with third-party platforms strictly through their official APIs and documented interfaces. We honor published rate limits, quota policies, and developer requirements. We do not use undocumented endpoints, unofficial clients, headless browser automation of authenticated sessions, scraping, or any technique that circumvents platform controls.

Users may not use the Service, or our API access, to build competing services, resell raw platform data, or otherwise breach the developer terms of any integrated platform.

You are responsible for:

• Ensuring you hold all rights necessary for the Content you upload or generate.
• Reviewing AI-generated Content for accuracy, legality, and platform compliance before publishing.
• Maintaining the confidentiality of your account credentials and OAuth authorizations.
• Complying with the community guidelines and monetization policies of every platform you publish to.
• Any consequences that result from Content you publish through the Service.

Your use of the Service is also governed by our Privacy Policy, which describes what personal information we collect, how we use and share it, and the choices available to you. We are committed to protecting your personal information and processing it responsibly and lawfully.

We apply reasonable administrative, technical, and organizational safeguards designed to protect the confidentiality and integrity of your data, including encryption in transit, encryption at rest for sensitive credentials such as OAuth tokens, role-based access controls, and audit logging. No system, however, is completely secure; you use the Service at your own risk and agree to notify us promptly of any suspected compromise of your account.

GrowthHub Studio is designed to operate in compliance with the developer policies of the platforms it integrates with, including the YouTube API Services Developer Policies, Meta Platform Terms, and TikTok Developer Terms of Service. You agree not to use the Service in any manner that would cause GrowthHub Studio to breach those policies, and to promptly cease any activity we identify as non-compliant.

We strive to keep the Service available and performant but do not guarantee uninterrupted or error-free operation. Scheduled maintenance, software updates, third-party outages, API deprecations, or force-majeure events may temporarily affect functionality. We may modify, suspend, or discontinue any part of the Service at any time.

Refunds are provided solely in accordance with our Refund Policy, which is incorporated into these Terms by reference. Except as required by applicable law or as expressly stated in that policy, all fees paid are non-refundable.

We may suspend or terminate your access to the Service, with or without notice, if you:

• Violate these Terms or our Acceptable Use Policy.
• Abuse, disrupt, or attempt to circumvent the Service or its safeguards.
• Engage in fraudulent, deceptive, or illegal activity.
• Attempt artificial engagement or any manipulation of third-party platforms.
• Create a legal, security, or reputational risk to GrowthHub Studio or its users.

You may terminate your account at any time from your account settings. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and governing-law provisions.

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, GrowthHub Studio disclaims all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. We do not warrant that the Service will meet your requirements, be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, GrowthHub Studio and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business, arising out of or in connection with your use of the Service, including but not limited to:

• Data loss or corruption.
• Account suspensions, strikes, demonetization, or terminations by third-party platforms.
• Policy violations committed by users of the Service.
• Third-party outages, API changes, or deprecations.

In no event shall our aggregate liability for any claim arising out of or relating to the Service exceed the greater of (a) the amounts you paid to GrowthHub Studio in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

We may update these Terms from time to time to reflect changes to the Service, our business, or applicable law. Material changes will be communicated through the website, in-app notice, or email where appropriate. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of those Terms.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which GrowthHub Studio is established, without regard to its conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the competent courts of that jurisdiction for the resolution of any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.
